Effective date: October 9, 2026
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This notice applies to Progressive Eye Care LLC and its workforce when handling your protected health information, whether in paper, electronic, or other form. It explains your privacy rights, our duties, and how we may use and share your information. Contact our Privacy Officer at 801-676-2020 or write to the address above to ask questions, exercise your rights, or file a complaint.
Your rights
See or obtain your records
You may ask to inspect or receive an electronic or paper copy of your medical record and other health information in our designated record set, including relevant billing records. Contact our Privacy Officer for help making a request. We generally act within 30 days. If a permitted extension is necessary, we will explain the reason and expected completion date in writing. We may charge only a reasonable, cost-based fee permitted by law. If we deny access, we will explain why and any available review rights.
Request a correction
You may request an amendment if you believe information we maintain is incorrect or incomplete. Submit your request and reason to our Privacy Officer in writing. We generally respond within 60 days; if a permitted extension is needed, we will notify you in writing. If we deny your request, we will explain why and how you may submit a statement of disagreement.
Request confidential communications
You may ask us to contact you in a particular way or at a different location, such as using a specified phone number or mailing address. Tell our Privacy Officer how you would like to be contacted. We will accommodate reasonable requests.
Ask us to limit uses or disclosures
You may ask us to restrict information used or shared for treatment, payment, or health care operations, or shared with people involved in your care. Submit your request to our Privacy Officer. We generally do not have to agree. If we agree, we will follow the restriction except where law permits or requires an exception, such as emergency treatment. If you pay in full out of pocket for an item or service and request that we not disclose related information to your health plan for payment or operations, we must honor that request unless disclosure is required by law.
Your rights and choices
Receive an accounting of disclosures
You may request a list of certain disclosures of your information during the six years before your request. This accounting generally excludes disclosures for treatment, payment, health care operations, disclosures you authorized, and other legally excluded disclosures. Contact our Privacy Officer to request it. One accounting in any 12-month period is free. We may charge a reasonable, cost-based fee for additional accountings and will tell you the fee in advance so you can withdraw or modify the request.
Receive a copy of this notice
You may obtain a paper copy promptly upon request, even if you agreed to receive this notice electronically. Ask our office or Privacy Officer. This notice is also available on our website.
Have a personal representative act for you
A person legally authorized to act for you, such as a legal guardian or health care agent with applicable authority, may exercise your rights. We will verify that authority and follow applicable laws, including rules concerning minors and exceptions involving abuse, neglect, or endangerment.
File a privacy complaint
If you believe your privacy rights have been violated, contact our Privacy Officer by phone or send a written complaint to the practice address on page 1. You may also complain to the U.S. Department of Health and Human Services Office for Civil Rights at https://www.hhs.gov/hipaa/filing-a-complaint/index.html, by calling 1-877-696-6775, or by writing to 200 Independence Avenue SW, Washington, DC 20201. We will not retaliate against you for filing a complaint.
Family members and others involved in your care
With your agreement, or when you have an opportunity to object and do not object, we may share information relevant to a family member, friend, or other person’s involvement in your care or payment for care. We may also share limited information for disaster relief. If you cannot express a preference, we may share relevant information when our professional judgment indicates it is in your best interest, as permitted by law. Tell us your preferences.
Uses that require your written authorization
We will obtain your written authorization for uses or disclosures requiring it under HIPAA, including most uses or disclosures of psychotherapy notes, marketing that requires authorization, and a sale of protected health information. We will also obtain authorization for uses and disclosures not otherwise described in this notice or permitted or required by law. You may revoke an authorization by notifying our Privacy Officer in writing. Revocation does not undo actions already taken in reliance on your authorization.
Fundraising communications
If we use permitted information to contact you about fundraising for our practice, you may opt out of further fundraising communications using the instructions provided. Your decision will not affect your treatment or payment. Before using records protected by 42 CFR Part 2 for fundraising, we will give you a clear and conspicuous opportunity to elect not to receive those communications.
How we use and share your information
We may use or disclose your information for the purposes below only when the applicable legal requirements are met. More protective federal or Utah laws may limit a disclosure that HIPAA otherwise allows. The additional restrictions for substance use disorder records on page 4 apply to all of these purposes.
Treatment
We may use your information to provide and coordinate care and share it with other treating professionals. For example, we may send examination findings to an ophthalmologist for cataract care or consult your primary care provider about diabetic eye disease. We may contact you about appointments, treatment alternatives, or health-related services.
Payment
We may use and share information to bill for services, verify coverage, obtain authorizations, and collect payment. For example, we may send your diagnosis and examination information to your health or vision plan so it can process a claim.
Health care operations
We may use and share information to operate our practice, improve care, train staff, assess quality, and perform administrative functions. For example, we may review charts to improve glaucoma follow-up. Vendors performing functions involving protected health information for us must have appropriate privacy safeguards and business associate agreements when required.
Public health and safety
As permitted or required by law, we may disclose information to public health authorities, report adverse reactions or product problems, assist with recalls, report suspected abuse, neglect, or domestic violence, and help prevent or lessen a serious and imminent threat to health or safety.
Health oversight and research
We may disclose information for authorized oversight, including audits, investigations, inspections, and licensure activities. We may use or disclose information for research when the required authorization or another lawful basis, such as an approved waiver, applies.
Legal requirements and proceedings
We disclose information when required by applicable law, including to HHS to review HIPAA compliance. We may respond to court or administrative orders and to subpoenas, discovery requests, or other lawful processes only when the applicable privacy conditions are met. A subpoena alone does not automatically authorize every disclosure. Special restrictions apply to Part 2 records as explained on page 4.
Other legally permitted purposes
Subject to legal limits, we may disclose information for workers’ compensation; specified law enforcement purposes; organ, eye, or tissue donation; and to coroners, medical examiners, or funeral directors carrying out their lawful duties. We may also disclose information for authorized military, national security, intelligence, protective services, or correctional functions when the applicable requirements are met.
Special protections and our responsibilities
Substance use disorder records
Some substance use disorder treatment records received from federally assisted treatment programs are protected by 42 CFR Part 2 in addition to HIPAA. These special protections apply when we receive or maintain such records; a substance use history recorded independently during an eye examination is not automatically a Part 2 record.
We will comply with Part 2 consent requirements and other restrictions when using or sharing protected records. A valid Part 2 consent may permit uses and disclosures for future treatment, payment, and health care operations. When we receive records under that consent, HIPAA and Part 2 may permit further uses or disclosures without a separate consent, subject to the restrictions below and other applicable law.
Part 2 records, and testimony conveying their contents, may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you without your specific written consent or a qualifying court order issued after notice and an opportunity to be heard have been provided to you or the holder of the records, as Part 2 requires. A court order authorizing use or disclosure must also be accompanied by a subpoena or other legal requirement compelling disclosure. Consent for legal proceedings must be separate from consent for other uses or disclosures. For example, ordinary permission to share records for treatment does not authorize us to provide those records for a criminal proceeding against you.
Other protected information
When applicable federal or Utah law provides greater privacy protection, we follow those requirements. Depending on the record and circumstances, additional restrictions may apply to mental health, HIV or other sensitive information, or records concerning minors. We obtain any additional consent or authorization required before disclosure.
Our legal duties
We are required by law to maintain the privacy of your protected health information, provide this notice of our legal duties and privacy practices, and follow the notice currently in effect. We must notify affected individuals after a breach of unsecured protected health information as required by law. We maintain safeguards to protect your information and limit uses and disclosures as the law requires.
Changes to this notice
We reserve the right to change this notice and our privacy practices as permitted by law, and to apply the changes to all protected health information we maintain, including information created or received before the change. A revised notice will show its effective date and will be available upon request, posted prominently in our office, and available on our website.
